Welcome to Velvet Lash Co. These Terms of Service (the “Terms”) are a legally binding agreement between you and Velvet Lash Co (“Velvet Lash Co,” “we,” “us,” or “our”) that govern your access to and use of our website, any related webpages, mobile experiences, and online services (collectively, the “Site”), as well as any purchases or transactions made through the Site (collectively with the Site, the “Services”).

By accessing or using the Site, creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms and any policies referenced in these Terms, including our Privacy Policy and Return Policy (together, the “Policies”). If you do not agree, do not use the Services.

If you are using the Services on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.

IMPORTANT NOTICE REGARDING ARBITRATION AND CLASS ACTION WAIVER

These Terms include an arbitration agreement and a class action waiver. With limited exceptions, disputes must be resolved by binding arbitration on an individual basis, not in court, and not as part of a class or representative action.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to make purchases through the Site. If you are under 18, you may use the Site only with the involvement and permission of a parent or legal guardian.

We may refuse service to anyone at any time for any reason, to the extent permitted by law.

3. Account Registration and Security

You may be able to create an account to access certain features (an “Account”). You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You agree to notify us immediately if you suspect unauthorized access or use of your Account.

We reserve the right to suspend or terminate Accounts that violate these Terms or are used in a way that we believe may create risk for Velvet Lash Co, other users, or third parties.

4. Use of the Site

You agree to use the Services only for lawful purposes and in accordance with these Terms.

You agree not to:

  • interfere with or disrupt the Site or servers

  • attempt to gain unauthorized access to the Site, Accounts, or systems

  • scrape, crawl, or use automated methods to access the Site without our written permission

  • reverse engineer, decompile, or attempt to extract source code from the Site

  • use the Site to build or promote a competing product or service

  • post or transmit any unlawful, harmful, harassing, defamatory, obscene, or otherwise objectionable content

We may modify or discontinue the Services, in whole or in part, at any time.

5. Intellectual Property

All content on the Site including text, graphics, logos, product names, images, videos, design, and software (collectively, “Content”) is owned by or licensed to Velvet Lash Co and is protected by intellectual property laws.

You may access and use the Site for your personal, non commercial use. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any Content without our prior written consent.

“Velvet Lash Co” and related brand names, logos, and marks are trademarks of Velvet Lash Co. All other trademarks belong to their respective owners.

6. Third Party Links and Services

The Site may contain links to third party websites, services, or resources (“Third Party Services”). We provide these links for convenience only and do not endorse them. We are not responsible for the content, policies, or practices of Third Party Services. Your use of Third Party Services is at your own risk.

7. User Content and Social Sharing

If you submit, upload, post, tag, or otherwise share content with us or through the Services, including photos, videos, reviews, testimonials, comments, or messages (collectively, “User Content”), you represent that you own or have permission to use that User Content and that it does not violate any third party rights or laws.

Permission to Use Social Content

If you tag @velvetlash_co or use #velvetlashco and we request or you otherwise provide permission for us to share your content, you grant Velvet Lash Co a non exclusive, worldwide, royalty free license to use, reproduce, publish, display, and distribute that content for marketing, promotional, and commercial purposes across our channels, including the Site, email, and social media. This includes your handle and any accompanying caption as posted, unless you request otherwise in writing.

If you want us to remove previously shared User Content, contact us at support@velvetlashco.myshopify.com and we will consider your request.

8. Product Information and Professional Use Disclaimer

Velvet Lash Co offers lash related products and supplies. Product descriptions and images are provided for convenience. We do our best to display products accurately, but we cannot guarantee that descriptions, photos, colors, or other content are error free.

Certain products may be intended for professional use. You are responsible for using products safely, following all instructions and industry best practices, and complying with applicable licensing requirements in your state or jurisdiction.

No Medical Advice: The Site may include beauty tips or educational content. This content is for informational purposes only and is not medical advice. If you have a medical concern, consult a qualified healthcare provider.

9. Orders, Pricing, and Payment

By placing an order, you agree that:

  • you are authorized to use the payment method provided

  • the information you provide is accurate and complete

  • you will pay all charges, including taxes and shipping, presented at checkout

We reserve the right to:

  • correct pricing errors, even after an order is submitted

  • limit quantities purchased per person or per order

  • refuse or cancel orders, including for suspected fraud or unauthorized activity

If we cancel an order after payment, we will issue a refund to the original payment method, to the extent required by law and consistent with our posted policies.

10. Shipping and Delivery

Shipping timelines are estimates and not guarantees. Title and risk of loss pass to you upon delivery to the carrier, to the extent permitted by law.

If a package is marked as delivered but you cannot locate it, you agree to contact the carrier first and then contact us with your order details so we can assist based on the carrier’s tracking information.

11. Returns, Exchanges, and Final Sale Items

Our return and exchange practices are described in our Return Policy located on the Site.

Because lash supplies and cosmetics can be sensitive, certain items may be non returnable for hygiene and safety reasons, including but not limited to opened products, adhesives, liquids, and items marked final sale, to the extent permitted by law.

12. Subscriptions and Recurring Charges (If Applicable)

If you purchase a subscription or recurring shipment option, you authorize us (or our payment processor) to charge your payment method on a recurring basis according to the plan you select until you cancel. You may cancel according to the instructions provided at checkout or on the Site.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and all Content are provided on an “as is” and “as available” basis. Velvet Lash Co disclaims all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement.

We do not guarantee that the Site will be uninterrupted, secure, or error free.

14. Limitation of Liability

To the fullest extent permitted by law, Velvet Lash Co and its owners, employees, contractors, agents, affiliates, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services or any products purchased through the Site.

To the fullest extent permitted by law, Velvet Lash Co’s total liability for any claim arising out of or relating to the Services will not exceed the greater of:

  • the amount you paid to Velvet Lash Co for the applicable purchase in the 12 months before the event giving rise to the claim, or

  • $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless Velvet Lash Co and its affiliates, owners, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of or related to:

  • your breach of these Terms

  • your misuse of the Services

  • your violation of any law or third party right

  • your User Content

16. Arbitration Agreement and Class Action Waiver

16.1 Informal Resolution

Before filing a claim, you agree to try to resolve disputes informally by sending written notice to support@velvetlashco.myshopify.com with your name, email, order number (if applicable), and a description of the dispute and requested relief. We will attempt to resolve the dispute within 30 days.

16.2 Binding Arbitration

If we cannot resolve the dispute, you and Velvet Lash Co agree that any dispute arising out of or relating to these Terms, the Services, or products purchased through the Site will be resolved by binding arbitration on an individual basis, except:

  • disputes that qualify for small claims court

  • disputes seeking injunctive relief for alleged unlawful use of intellectual property

Arbitration will be administered by JAMS under its applicable rules. The arbitration will take place in Randall County, Texas, unless the parties agree otherwise.

16.3 Class Action Waiver

You and Velvet Lash Co agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

16.4 Opt Out

You may opt out of arbitration within 30 days of the date you first accept these Terms by emailing support@velvetlashco.myshopify.com with your name, address, and a clear statement that you want to opt out of arbitration.

17. Termination

We may suspend or terminate your access to the Services at any time for any reason, including suspected fraud, abuse, or violation of these Terms.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles.

If arbitration does not apply, you agree that any dispute will be brought in the state or federal courts located in Randall County, Texas, and you consent to personal jurisdiction there.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top. Your continued use of the Services after changes become effective means you accept the updated Terms.
